Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the QuickStaging website and AI virtual-staging service (the “Service”), operated by Max Werner, a sole proprietor based in Germany, trading as QuickStaging (“we,” “us,” or “our”). By placing an order, creating a free preview, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
QuickStaging turns photographs of empty or sparsely furnished rooms into virtually staged images by adding furniture and decor with generative AI. The Service is intended for real-estate professionals to illustrate listings.
The Service is offered exclusively to entrepreneurs (Unternehmer) within the meaning of § 14 of the German Civil Code (BGB) — real-estate agents, agencies, and other customers acting in the course of their trade, business, or profession. It is not directed at, or offered to, consumers (§ 13 BGB). By placing an order you confirm that you are entering into the contract for your business or professional activity. Because contracts under these Terms are not consumer contracts, the statutory right of withdrawal for consumer distance contracts does not apply.
2. Eligibility & account
You must be at least 18 and have authority to enter these Terms (on behalf of your agency, where applicable). We sign you in with a one-time email link rather than a password; you are responsible for the security of your email inbox.
Plans that include more than one seat let you invite colleagues, who sign in with their own email addresses. An invitation grants nothing until the invited person accepts it from their own account. While a seat is active, that colleague can see and download the listings on your account and can create new ones against your monthly quota; listings they create belong to your account and remain there if their seat ends. You remain the account holder and the contracting party for everything done on your account, including by a colleague you have seated, and you are responsible for removing seats you no longer want.
3. Furniture only — no structural changes
Our renders add furniture and decor only. Every render is generated under an explicit instruction not to alter walls, windows, doors, floors, ceilings, fixtures, or the view through a window, and the output preserves your original's aspect ratio and framing. We retain your original alongside each render so the two can be compared, and re-rolls are free. Generative models are not deterministic, so we do not warrant that every render is free of structural drift: you are responsible for reviewing each image before you publish it. This is the core integrity rule of the Service — a staged image must depict the same property you photographed.
4. Disclosure obligation (important)
Virtually staged images are generated by AI: the furniture and décor are added digitally and are not physically present in the property. Whenever you publish a staged image, you must clearly disclose that it has been virtually staged. Every download you receive includes three versions — your unaltered original, a clean image and a corner-badged “Virtually staged” version — plus a one-line disclosure note. When publishing, use the badged version and/or include the disclosure note, according to the portal's format.
You must not remove, obscure, or alter the disclosure badge, the disclosure note, or any embedded provenance metadata where disclosure is required. You are responsible for complying with the marketing and anti-misrepresentation rules that apply to your listings. Misrepresenting a property as physically furnished is a misuse of the Service.
5. Your content & licence
You retain ownership of the photos you upload and warrant that you have the rights to upload and stage them. You grant us a limited licence to process them solely to provide the Service. We grant you a worldwide, royalty-free licence to use the resulting staged images for marketing the depicted property, including commercial listing use.
Every paid listing has a share link you can send to a client. Anyone holding that link can view and download that listing's images without signing in, so treat it as public and share it only with people you intend to have it; the page is not indexed by search engines, and it stops working when the listing is deleted or its retention period ends. Shared images carry the mandatory compliance label and the disclosure note in every case. Plans that include the white-label option remove our branding from the page; they do not remove that label or that note.
6. Plans, billing & cancellation
Prices are shown and charged in euros (EUR), pounds sterling (GBP) or US dollars (USD), depending on the market you are quoted in. The amount shown at checkout is the amount charged: we apply no currency conversion of our own. Stripe fixes a customer's currency at their first payment, so if you have paid us before, later purchases stay in that currency and our pages quote it back to you.
Payments are handled by our payment processor, Stripe. Subscriptions (Agent, Office) renew monthly until cancelled and include a monthly listing quota; the one-time plan covers a single listing. Re-rolls of a render do not count against your quota. You can cancel anytime from the customer portal; cancellation stops future renewals and is not pro-rated for the current period.
No tax is added at checkout — the price you see is the total, in every market. We are a small business under § 19 UStG (Kleinunternehmerregelung), so no German VAT is charged or shown. A business customer outside Germany may still have its own VAT or sales-tax obligations on the purchase, such as accounting for UK VAT under the reverse-charge rules; that is a matter between you and your own tax authority, and nothing here is tax advice.
7. Free preview & guarantee
The free preview stages one room and is yours to download, with no payment required. Like the paid product, it carries the mandatory “Virtually staged” compliance label. If your first staged room is not good enough to publish, you owe nothing. After that, you can re-roll any render for free until it is publishable.
8. Acceptable use
You agree not to upload content you have no rights to, attempt to defeat the furniture-only or disclosure mechanisms, resell the Service, or use it to misrepresent a property. We may suspend accounts that abuse the free preview or these Terms.
9. Availability & liability
The Service is provided on a best-effort basis. To the extent permitted by law, we are not liable for indirect or consequential damages; nothing in these Terms limits liability that cannot be limited under German law (including for intent, gross negligence, or injury to life or health). You remain responsible for reviewing each staged image before publishing it.
10. Changes & governing law
We may update these Terms; material changes will be notified by email or in-app. These Terms are governed by the laws of Germany, excluding its conflict-of-law rules and the UN Sales Convention. Mandatory consumer protections of your country of residence remain unaffected.
